Honble Supreme Court comprising Chief Justice of India Shri Ranjan Gogoi , Justice Deepak Gupta and Justice Anirudd Bose Heard the case On Thursday 1 August 2019 of entitlement for Pension of Gramin Dak Sevaks , and Honble Supreme court was pleased to reserved the Judgements after hearing Mr Mukesh kumar Giri Advocate supreme court on behalf of G D S and Additional Solicitor General shri Atmaram Nadkarni for central Government Which challenged the Pensinary benefit to Group D regular employees saying that they did not complete 10 year qualifying service in regular so not entitle for pension.
Mr Giri emphatically argued that Group D regular is promotion from G D S Cadre So entire service has to be counted and this can not be bifurcated into two components . Mr Giri further argued that Honble supreme court allowed writ petion no 17 of 2009 Vinod saxena and 1788 GDS others versus Union of India and granted them status of civil post and directed Central Administrative Tribunal New Delhi to decide Pensionary issue and valididy of Rule 6 of 2011 Rules , the CAT vide 17.11.2016 Judgement granted pension to all GDS and strike down illegal rule 6 and after 30 months central Government can not deny pension to GDS. On behalf of central Govt Ld ASG said that they are 3 lakhs so financial burden would be there.court will deliver its verdict in due course
